2) Scope
These Terms & Conditions apply to bookings of holiday accommodation that are requested and booked via this website (including the booking widget) as well as bookings requested and made directly with ESPECIALANZ S.L. by email. For bookings made via third-party platforms (e.g. Airbnb/Booking.com), additional platform terms may apply; in the event of a conflict, the platform terms take precedence.
3) Formation of contract
(1) The presentation of the accommodation and prices on this website does not constitute a binding offer.
(2) A binding rental agreement is concluded once we have received the deposit payment and we have confirmed the booking (by email or automatically via the booking system).
(3) Until booking confirmation, availability and prices may vary (dynamic pricing).
4) Prices and included services
(1) The total price shown in the booking confirmation applies. Once the booking is confirmed, the price is binding.
(2) Unless expressly stated otherwise during the booking process, taxes and usual utilities/ancillary costs are included in the total price shown.
(3) Final cleaning is included in the total price, but may be shown as a separate line item during the booking process.
5) Payment terms
(1) The deposit is typically 50% of the total price. The balance payment is due on the date stated in the booking confirmation and/or invoice.
(2) Depending on the booking channel, the deposit can be paid by card (e.g. via Stripe) or by bank transfer. The balance payment is usually made by bank transfer. We reserve the right to adjust the available payment methods in individual cases.
(3) Any payment provider fees (e.g. Stripe) are borne by us, unless stated otherwise during the booking process.
6) Security deposit
We may require a security deposit of up to EUR 300. Any security deposit due will be shown on the balance payment invoice and is not included in the total price displayed on the website. If no claims arise, the security deposit will be refunded within 7 days after departure.
7) Use of the accommodation / House Rules as part of the contract
(1) The accommodation may only be used by the number of persons stated in the booking.
(2) The House Rules form part of the rental agreement. In the event of serious breaches, we may terminate the agreement in accordance with applicable law and/or claim additional costs (e.g. special cleaning, damages).
8) Pets
Pets are permitted only by prior agreement. Without written confirmation, there is no entitlement to bring pets.
9) Defects and remedy
(1) Please report any defects or damage without delay so that we can remedy the issue.
(2) Your point of contact is the property manager or the contact point provided in the house information sent to you before arrival.
10) Liability
(1) We are liable only in accordance with statutory provisions for intent and gross negligence, as well as for damage resulting from injury to life, body or health.
(2) Note on amenities (e.g. pool heating, Wi-Fi): These are part of the accommodation description. If, in individual cases, there are restrictions or outages, we will aim to clarify the situation promptly and—where possible—remedy it. Any statutory warranty rights and rights to reduce the price remain unaffected.
11) Damage, duty of care, keys
(1) The guest is liable for damage caused by them, their fellow travellers or visitors in accordance with applicable law.
(2) Damage, defects or unusual issues should be reported to us or the property manager promptly.
12) Statutory guest registration requirement
In Spain, there is a legal obligation to record certain guest details. You are required to provide the necessary information and ID details for this purpose. Instructions are provided in the documents sent to you before arrival. Further information about data processing can be found in our Privacy Policy.
13) Applicable law and jurisdiction
(1) Spanish law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.
(3) For consumers, the statutory places of jurisdiction apply; consumers may generally bring claims at their place of residence, where provided by law.
14) Severability
If any provision of these Terms & Conditions is or becomes wholly or partly invalid, the remaining provisions shall remain in full force and effect. The statutory provision shall apply in place of the invalid provision.
